In December 2000, temporary social housing residents fly tipped on the triangle of flood plain land adjacent to the rear of 15 Wentworth Street properties. This rubbish contained soiled nappies, hypodermic needles, soiled mattresses, rotting household waste and piled up dustbin liners overflowing with evil smelling waste. Erewash Borough Council publicly REFUSED to take any action as in their view it did not constitute a health hazard and was not classed as litter.

ON THE 15th OF MARCH 2001 EREWASH BOROUGH COUNCIL STATED:

Environmental Health

"We have had a look at it and it does not constitute a statutory nuisance."

THIS FLY TIPPING WAS LEFT TO COLONISE FOR ALMOST 6 YEARS. ON THE 4th OF SEPTEMBER 2006 EREWASH BOROUGH COUNCIL SUDDENLY STARTED TO PILE THE DEBRIS INTO A HEAP READY FOR REMOVAL. AFTER SIX YEARS EREWASH BOROUGH COUNCIL HAD FINALLY DECIDED IT WAS A HEALTH HAZARD AFTER ALL.

The triangle of flood plain land the fly tipping had colonised contained a mature, well established copse of trees. These trees created a valuable wildlife barrier on land which served as a buffer between residential and complete heavy industrial encroachment. As the fly tipping was finally going to be removed, the residents saw an opportunity to improve the area their gardens backed on to by clearing the remaining accumulation of debris away and planting additional trees to add to the existing vegetation.

Less than 24-hours later at EXACTLY the same time as EBC was removing the fly tipping on the 11th of September 2006, contractors previously hired by Rayden Engineering was installing a 2.4 metre steel palisade security fencing around the whole previously fly-tipped site.

Not only did Rayden Engineering and the council ignore the residents obviously staked out intention to occupy and improve the land, but also trespassed onto the 1937 established easement boundary attached to the entire row of 15 properties, thus acquiring an additional strip of land. This 69 year old established easement was clearly staked out with bunting from the previous day and Rayden Engineering's own Title Deeds also show the exact width of the easement which had also just been stolen from the residents with, by Rayden Engineering admittance, the assistance of Erewash Borough Council and the local police.

Nearly six years after this fly-tipping had first taken place and Erewash Borough Council had refused to take any remedial action - Erewash Borough Council stated:

"We are pleased to have been able to undertake the clearance of the considerable fly tipped waste...."

Then, after demands by the residents for a suitable explanation, instead of taking Enforcement Action to remove a 2.4m palisade fence, erected with the council’s assistance without planning permission and over the legal height limit, EBC reluctantly made Rayden Engineering paint it an "invisible" green so we would not notice it and it would “invisibly” blend in with Erewash Borough Council’s ‘Green Space Strategy’. Perhaps the Leader of EBC supplied the green paint from the supply he carries everywhere to ‘paint Erewash Green’!

EREWASH BOROUGH COUNCIL HAS ENJOYED THE TRADITIONAL SILLY SEASON SO MUCH THAT THEY HAVE VOTED AN AMENDMENT TO EXTEND THE PANTOMIME SEASON FOR THE ENTIRE YEAR....AND THE YEAR AFTER THAT IN A GESTURE OF GOODWILL TOWARD THEIR CITIZENS.

On Sunday the 10th of September 2006 the residents worked on a voluntary basis, and at their own cost hired a mechanical digger to clear the remainder of six years of neglect away.

HEALTH HAZARD OR NOT??

THE DECISION WHICH TOOK SIX YEARS TO MAKE!

“At the suggestion of the Council and at the advice of the local police, (Rayden Engineering) allowed the council to arrange for fencing to be put up around the disputed land”.

If the above statement is true then after six years of Erewash Borough Council being unable to remove substantial fly -tipping from private land to benefit the residents as it did not constitute a health hazard, Erewash Borough Council not only cleared this debris from private land for the sole benefit of a developer but in addition donated flood land that did not belong to them to the same developer for industrial expansion and also arranged for fencing to be installed round the stolen land which was above their own legal height limit and clearly required planning permission before it was erected, A material change of use to this newly acquired land also required planning permission - yet neither had been applied for before the destruction took place and despite prior knowledge, the council did nothing to prevent these clear beaches of planning legislation - WHY?? .

Again if the Rayden Engineering statement is true then one would be forced to question why the local police were advising a private individual over how to trespass and steal something that did not belong to them. A private individual who with encouragement from the local police has monetarily profited from this acquisition of additional land at the expense of his residential neighbours and why the local police chose to encourage trespass and theft.

“The Environmental Health department of Erewash Borough Council contacted all local residents to ascertain whether any had rights in a unused parcel of land adjacent to (Rayden Engineering) premises.”

COMMENT: Really?? So presumably all of the residents letters got lost in the post or Erewash Borough Council forgot to write them or Erewash Borough Council forgot to post them. Not one local resident was contacted or informed of the free land giveaway, undeveloped flood land which had previously protected 15 residents properties.
