Though listed as two separate entities, Sportoffer Ltd is The Manor Fitness and Squash Club, the latter having a 99-year lease which includes a restrictive covenant restraining the use as a squash club and for no other purposes.  The landlord EREWASH BOROUGH COUNCIL took legal action in 1999 to enforce this covenant and won: See Sportoffer Limited v Erewash Borough Council (1999) EGLR 213.  In the space of one week in 2008 Dastardly Dick became the proud owner of all three associated companies and in view of Erewash Borough Council closing the centrally located Albion Leisure Centre it will be interesting to see if Richard Hayden’s new landlords will enforce this covenant restricting the use to squash, especially as their friend will be in direct competition with the council’s own Rutland Sports facility only just around the corner - the very principles they spent council tax-payers money on through legal action to uphold.
