An analysis of the SECOND  Flood Risk Assessment commissioned by Rayden Engineering and compiled by EPG Clear Ltd. Consultants hired and paid for by Rayden Engineering to produce an independent Report for submission to The Environment Agency and The Planning Inspectorate in SUPPORT of the Rayden Engineering Appeal against refusal of planning permission to develop the stolen flood zone 3 land. A Report Erewash Borough Council was initially reluctant to disclose to the residents and a Report that the Environment Agency accepted as a valid reason to drop their objections to the development of a high risk flood plain which had already been developed without any form of drainage.

The Environment Agency has not yet responded to our repeated queries over why they dropped their objections based upon the EPG Clear Ltd flood analysis.

EPG CLEAR LTD:

There are no depressed areas which could encourage ponding and no evidence of ponding was observed during the walk over survey of the site. Therefore, no further consideration has been given to ponding within the development site.” (Para 3.2)

COMMENT: The EPG Clear Ltd walk over survey of the site took place on the 18th of May 2007. One day earlier on the 17th of May 2007 a letter  was sent to Erewash Borough Council accompanied by  THE ABOVE photograph of the water logged Appeal site expressing concern over the increased flood risk from this developed flood land. Meteorological Records confirm that May 2007 had been the wettest May for 40 years with a record amount of rainfall.

“The latest recorded incident  (of flooding) occurred in 1922, when heavy rains caused flooding of many houses along the banks of the River Erewash.”  (Para 3.1)

COMMENT: So the ‘Ilkeston Junction Floods 1932; the ‘Worst Floods of the Century1956; the ‘Floods Hit the Junction1957; the ‘Wentworth Street Floods1960; the ‘They Fear More Flooding1961; the 1976, 1985 and the year 2000 floods were all figments of over active imaginations then??

EPG CLEAR LTD: “The area is outside the rapid inundation zone of the River Erewash if defences were to breach” (Para 5.1)

COMMENT: So on the 26 of June 2007 we did not flood from the River Erewash then?

EPG CLEAR LTD: “Surface water runoff from the development will remain unchanged.” (Para 5.3)

COMMENT: So on the 26 of June 2007 we did not flood from the River Erewash OR the non porous development of stolen flood land 3 metres from our properties then??

SO WHERE EXACTLY DID THE WATER THAT FLOODED 15 HOMES  ADJACENT TO THE  FLOOD PLAIN DEVELOPMENT COME  FROM THEN?

COMMENT: Both EPG Clear Ltd and the Environment Agency breach analysis maps are IDENTICAL.  How ever the EPG Clear flood risk map has flood “Danger Zone” labels attached to it. The flood ‘DANGER FOR ALL’ label has been attached to the Erewash Canal OUTSIDE the actual flood zone! A fact admitted by EPG Clear Ltd on page 12 of their FRA which states:

“Water levels within the canal are designed to remain static and therefore the risk of flooding from this source does not require further consideration.

The ‘DANGER FOR SOME’ label sits in the middle of the Environment Agency designated flood ‘Danger Zone’. This flood “Danger for Some” label had been calculated according to the distance of the River Erewash from the actual development site of the stolen flood plain. HOWEVER, although EPG Clear state the land has no positive drainage - YET AGAIN no account has been taken of the fact that the ONLY drainage culvert crossing the stolen flood land CANNOT drain into the River Erewash  during high river levels as the automated flap valve into the River Erewash is CLOSED! The water draining all the way from Babbington Colliery, Awsworth, Cossall and through Ilkeston Junction during heavy precipitation and after, accumulates and backlogs to overspill on the PREVIOUSLY POROUS FLOOD ZONE 3 which was stolen and developed to a higher level than our homes with non-porous material.

EPG Clear assumed the stolen flood land which INCREASED our flood risk AND flooded a whole row of houses was a replacement development site for the now infamous CPO land. 1677 square metres of CPO land surplus to Derbyshire County Council requirements and which was returned to Dastardly Dicks ownership. 1677 square metres of non-porous land with only rainwater pipes and gullies for drainage that cannot positively drain into the River Erewash during high river levels. EPG Clear based their Flood Risk Assessment on the assumption that the total non-porous land would remain exactly as it had previously been when in fact non-porosity with no positive drainage has increased significantly.
